Terms and Conditions of Website Use and Product Purchase/Use

This website, 143VINYL™ (collectively reffered to as the "Site" in these Terms of Service and formerly known as 143VINYL.COM) is owned and operated by Vinyl Fanatic LLC ("we", "us", "143VINYL™", or "143VINYL.COM"). By using and accessing our Site, you ("you", "user" or, "end user") agree to these Terms of Service (collectively, the "Terms of Service" or "Agreement").

Purchase Verification

As part of fraud prevention measures we may contact you to verify your ID and request a picture of the credit card used to make your purchase while displaying only the last four digits of the card and the name on the card.  NEVER send your full credit card electronically.  We only need to verify the last four digits, name, and a matching ID for the cardholder.  

Sheet and Roll Sizes

Widths of all Rolls and Sheets are approximate and may vary up to about 1/4".  The rolls sizes from manufacturers vary and are never exact widths so when we cut them into sheets, sometimes the sheets are a bit smaller, sometimes they are a bit larger.  This will be the same for any vendor that converts sheets to rolls.  Rolls may vary in length, as well. We use very high quality (and expensive) equipment to measure the lengths when rolls are cut. However, there are sometimes variances that are difficult to control.  We do our very best to ensure rolls and sheets are sized consistently, but for them to always be exact is not possible.

You expressly agree that use of the Site is at your sole risk and discretion. The Site and all content and other information contained on the Site is provided on an "AS IS" and "AS AVAILABLE" basis without warranty of any kind, whether express or implied. 143VINYL™ makes no warranty that (I) the Site and content or information will be uninterrupted, timely, secure or error-free, (II) the results that may be obtained from use of this Site will be effective, accurate or reliable. The Site may include technical mistakes, inaccuracies or typographical errors. 143VINYL™ reserves the right to change the Site content and information at any time without notice.

Limitation of Liability

In no event shall 143VINYL™ or its affiliates be liable for any indirect, incidental, special, punitive damages or consequential damages of any kind, or any damages whatsoever arising out of or related to your use of the Site, the content and other information obtained therein.

Certain jurisdictions prohibit the exclusion or limitation of liability for consequential or incidental damages, thus the above limitations may not apply to you.

Governing Law

Any disputes arising out of or related to these Terms of Service and/or any use by you of the Site shall be governed by the laws of Jefferson County, Kentucky, United States without regard to the conflicts of laws provisions therein.

Termination of Use

We shall have the right to immediately terminate or suspend, in its discretion, your access to all or part of the Site with or without notice for any reason.

Email Subscriptions

If you are subscribed to our email newsletters, you may instantly opt out by clicking the link at the bottom of emails. You may also contact us by email at sales@143VINYL.COM if you are having difficulty unsubscribing. We do not share your email address with any third-party.

Clearance Items

All sales are final for items purchased from the clearance section, if available. These items may appear in other categories as well so if an item appears abnormally cheap, you should check to see if it's in the clearance section before purchasing. If clearance items have any damage or blemishes it will be noted in the description.

Specials, Discounts and Offers

Special offers, discounts and coupons may not be combined unless otherwise noted on the offer.

Order Acceptance Policy by Customer

Once you receive your order (date/time when tracking information shows "Delivered" status) you must notify us within five (5) business days if there are any issues with your order.  If you do not contact us within five (5) business days we will consider your order complete with no issues.  You may contact us by using the form on our website located at this link.  If you attempt to contact us and for some reason do not hear from us within about 24-48 hours, please call us at (502) 909-3100.  By placing an order on our website you are granting us permission to contact you regarding any specific order via phone, email, and/or text message.

Order Acceptance Policy by 143VINYL™

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. 143VINYL™ reserves the right at any time after receipt of your order to accept or decline your order for any reason and refund the price paid to the customer.

Other Conditions

These Conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether 143VINYL™ signs them or not. We reserve the right to make changes to this site and these Conditions at any time. It is the customer's responsibility to know our current Terms & Conditions regardless whether you are notified of changes or not. If you continue to use the Services after we change the Terms, you accept all changes.

Taxes

Our Store shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the same state. For orders shipped to other states, you are solely responsible for all sales and use or other taxes.

Typographical Errors

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we reserve the right to refuse or cancel any orders placed for product listed at the incorrect price. 143VINYL™ reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we will issue a credit to your card for the appropriate amount.

Registration and Access Control

You are responsible for maintaining the confidentiality of your login names and passwords and you accept responsibility for all activities, charges, and damages that occur under your account. If you have reason to believe that someone is using your account without your permission, you should contact us immediately. We will not be responsible for any loss or damage resulting from your failure to notify us of unauthorized use. If we request registration information from you, you must provide us with accurate and complete information and must update the information when it changes.
